These employees, who have been taken action, have lost their jobs, along with pension, gratuity and other benefits. More importantly, these persons will be barred from even applying for jobs in any government or semi-government organization in future. ‘Dismissal’ is administratively the most severe punishment.

200 employees are involved in the 142 cases filed with the Anti-Corruption Department. Out of these 142 cases, 105 cases have been given ‘pre-prosecution approval’ by the municipal administration. While the rest i.e. 30 out of 37 cases are still under investigation at the level of the Bribery Department itself. Therefore, they have not yet sought approval from the municipal administration. If these cases come up for approval, appropriate action will be taken by the municipal administration for sure and immediately. Out of the remaining 7 cases, in 4 cases the sanction decision has been communicated to the Anti-Corruption Department. In other 3 cases the approval process is in final stage.

Anti-corruption department received 395 complaints under section 17 (a) of the Prevention of Corruption Act against municipal employees. These complaints are mainly related to corruption in the performance of official duties by employees or alleged corruption in work etc. For example, potholes, poor garbage collection, neglected waste, poor condition of footpaths, water scarcity, poor spraying of insecticides, malpractice in public health works are the complaints. This means that these cases are not of ‘pre-prosecution sanction’ type. These written complaints are forwarded to various offices of the Municipal Corporation for necessary action.

The Brihanmumbai Municipal Corporation is constantly taking very strict action against corruption. According to the Prevention of Corruption Act of 1988, the Municipal Administration provides necessary support to the Anti-Corruption Department of the Government of Maharashtra. Under the Prevention of Corruption Act, the authority to file chargesheets at the court level rests with the Anti-Corruption Bureau, not the Brihanmumbai Municipal Corporation. Only ‘pre-prosecution approval’ to file a case is given at the Brihanmumbai Municipal Corporation level under Section 19 (1) of the Prevention of Corruption Act. Also, all necessary cooperation is provided by the Brihanmumbai Municipal Corporation administration in all the proceedings carried out by the Bribery Department.
